Terms & Conditions

Rates Policy

All rates are quoted & charged in Euro and include VAT. These are inclusive of comprehensive insurance, subject to applicable excess, unlimited mileage, and 24x7 road assistance service. Cars are supplied fully road licensed.

 

Standard CDW/TDW (Included)

The whole car fleet is insured comprehensively against theft and all damages arising from fire, vandalism or any road accident. In all these cases, the client is, however, liable to pay an excess charge of €700 (for groups A-F & I) and €900 (for groups H, J & K), unless 3rd party accepts fault and pays all damages, or damage cost is less than excess due.

 

Excess Waiver Options

  • Super CDW & TDW
    For an extra daily charge, the client may opt for a reduction of insurance excess liability in case of accident, damage or theft. Super Collision Damage Waiver and Theft Damage Waiver lower excess liability to €100 (for groups A-F+ & I) and €275 (for groups J & K). This applies to each and every claim resulting from accidents, damage, theft, attempted theft or vandalism.

  • Full Damage Waiver (FDW)
    For an extra daily charge, the client may opt to waive the insurance excess liability completely in case of an accident, damage or theft. This applies to all claims resulting from accidents, theft, attempted theft or vandalism. Certain restrictions to cover still apply.

 

Personal Accident Insurance (optional)

For a daily charge, this insurance will pay a lump sum (as predetermined by the insurance policy) should the driver suffer accidental bodily injury in direct connection with the rental car, if, within three months of the accident, the injury is the sole cause of death or loss of any limb or permanent loss of all sight in one or both eyes.

 

Exceptions to insurance cover

  • Client driving under the influence of drugs and/or alcohol.
  • Client’s failure in the event of an accident, to take the following necessary actions:
    • Ensuring vehicle is not moved from the place of impact until the traffic warden or the police are on the scene and making every endeavor to obtain names and addresses of parties involved and of witnesses
    • Not admitting liability of guilt and in no event discussing liability, dealing or settling with the other party or parties involved in the accident.
    • Not abandoning vehicle without adequate provision for safety, guarding and securing same.
    • Calling the nearest office of lessor by telephone even in case of slight damage and by giving a detailed report including a diagram to the lessor.
    • Notifying the police immediately in all cases especially if another party’s guilt has to be ascertained or if people are injured.
    • Filling in and signing the Statement of Facts On A Front-to-Rear Collision Form at the place of impact when a straightforward front to rear, bumper to bumper collision occurs.
  • Using hired vehicle for illicit/illegal purposes (e.g. smuggling, theft, illegal transport of items or goods, etc.)
  • Driving while overloaded, over the limit permitted according to the vehicle’s Circulation Permit
  • Driving by unauthorized persons, i.e. under the age restrictions, not declared and written on the rental agreement.
  • Using the vehicle for any kind of race or competition, including racing pacemaking
  • Driving the vehicle anywhere other than on authorized roads
  • Proven willful violation of traffic lights, stop signs, and speed limit, proven willful entry into counterflow traffic, proven willful entry into the wrong end of a one-way street
  • Any accident caused by gross negligence as determined by a Maltese court of justice
  • Damage to or Loss of car keys, GPS Navigation systems and car seats during the rental period
  • Interior upholstery damage including cigarette burns

Damages to any of the five wheels and tyres, windows, windscreens and soft tops are not covered by the Standard and Super CDW/TDW excess waiver options.

 

Accidents

In case of an accident during the term of this rental the renter must:

  • Not removing the vehicle from the place of impact before the traffic warden or the police are on the scene and making every endeavor to obtain names and addresses of parties involved and of witnesses
  • Not admitting liability of guilt and in no event to discuss liability, deal or settle with the party or parties involved in the accident
  • Not abandon the vehicle without adequate provision for safeguarding and securing same
  • Calling the nearest office of lessor by telephone even in case of slight damage and by giving a detailed report including a diagram to the lessor
  • Notifying the police immediately in all cases especially if another party’s guilt has to be ascertained or if people are injured
  • To fill in and sign the Statement of Facts On A Front-to-Rear Collision Form at the place of impact when a straightforward front to rear, bumper to bumper collision occurs

 

Delivery and Collection

Delivery and collection of vehicles is available to any address in Malta, at a nominal fee to logistic costs.

 

Additional Drivers

Named additional drivers can be added to the rental form, each at an extra daily charge to cover insurance. Each driver must present a valid driving license.

 

Fuel Policy & Charges

Vehicles are rented out with a full tank of fuel and should be returned with the same amount. In the event that the tank is not full upon collection you would only be charged for the missing fuel (at the same rate as the fuel station, no additional charges/penalties).

 

Baby / Child / Booster Seats & GPS Navigation

For an optional daily fee, we offer Baby Seats (mountable forward or rear facing), Child Seats, Booster Seats and GPS Navigation Systems. These options must be ordered in advance at reservation stage. Baby/Child/Booster seats will be pre-installed prior to delivery.

 

Driving age / Young drivers

All vehicles are insured to cover drivers aged between 25 & 75 which have held a valid driving license for a minimum of 2 years.
Drivers aged 23 & 24 (having held a valid driving license for a minimum of 2 years) are also insured to drive certain Categories, however, a young driver surcharge will be imposed. The excess would be lowered to €500 and no additional excess waiver option would be available. This is also applicable if the young driver is listed as an additional driver.

The €500 excess would be applicable to all drivers under the rental agreement.

 

Driving License

All named drivers must present a valid physical driving license at time of rental. Nothing other than the physical driving license will be accepted.
Both the license & license category expiry dates must be valid.
In the case of an International Driving Permit, the driving license issued in the holder's country must also be presented.

 

Guarantee of Vehicle Category Availability / Upgrades

This system only quotes respective rates and does not guarantee availability. Once the booking request has been submitted and availability is confirmed a confirmation e-mail will be sent.

We guarantee the vehicle category and full specifications of confirmed and in cases where this is not possible, the client will receive a vehicle of a higher category/specification.

 

Delivery Punctuality

Should any of our representatives be more than 15 minutes late, please call our office on (356) 2149 7301. This might happen when exact client location is not found.

 

24x7 Breakdown assistance

24x7 breakdown assistance is available anywhere in Malta & Gozo, free of charge. This service is only free for mechanical breakdowns.
Any out-of-fuel, misfuel situations, tyre puncture calls will attract a service charge.

 

Lost, Stolen, Broken or Locked-in Car Keys

Any lost, stolen, or broken car keys during the rental will be replaced. All costs including a delivery fee will be charged to the client, including cases where client locks key in the car. In cases where the car is dropped off at airport and client leaves Malta with the car key, the client must send the key by post via express courier at client’s expense. A daily charge will apply if the key is not received within 2 days.

 

Pre-Authorisation

As a security, a pre-authorisation of the relevant excess together with the amount equivalent to a full tank of fuel is required at time of rental. This amount will be blocked on the credit/debit card and will then be released automatically by the bank. The minimum pre-authorisation amount required is €150.

This is NOT a charge on the credit/debit card. A pre-authorisation is a security guarantee for payment only. The pre-authorisation fund is not held by JS Car Hire, the company that provides the credit card EPOS or by the authorising bank. The pre-authorisation funds are held on the card by the cardholder's issuing bank and are released automatically within one month from date of transaction. Should the pre-authorisation not be released within the stipulated time, is best to first contact the issuing bank.

It is important to note that when funds are released you do not see a refund of the amount; however the original transaction is either cancelled or disappears altogether.

 

Payment Method

Payment is accepted by credit card (Visa / Master Card), debit card (Visa Debit / Visa Electron / MasterCard Debit) or cash (a credit/debit card is still required).
Due to recent changes with one of our payment processors, AMEX cards are no longer accepted.

Cover for Parking, Over-speeding & Other Traffic Fines and Excess Amounts Due

Cash (a credit/debit card is always required as a security), Credit Card (VISA or MasterCard)  or Debit Card (Visa Electron, Visa Debit or MasterCard Debit) payments are accepted. To cover for any parking, over-speeding or other traffic fines, as well as any excess amounts due, clients must present us with a valid credit/debit card on delivery of vehicle even if they are paying for the rental in cash. Any fine or excess due will be automatically charged to the client's credit/debit card, advising the client by email.  

 

Card Holder

Credit/Debit Card Holder must be present at time of rental and may be requested to provide identification.

 

Internet & Late Bookings

We guarantee prices cited on this website as long as bookings are made in advance via the internet. Prices may be higher for last minute and locally booked rentals. We reserve the right to decline any bookings submitted less than 48 hours from the requested delivery date/time.

 

Incoming Flight Information

We will not be held responsible if the booked vehicle is not ready at the airport should the client not provide us with correct incoming flight information. This information is required for all rentals requiring vehicle delivery at the airport.

 

Premature termination of hire

Although under no obligation to do so, we may allow under special circumstances &/or valid reasons, a part refund of hire in cases of return of vehicle prior the rental termination date.

 

Late returns of hired vehicles

One hour grace from the agreed termination time of hire is allowed for the vehicle return, after which it reserves the right to charge up to a full day’s hire, and further days hire as the case may be. Additional collection fees & other charges may also be applicable if a vehicle is returned late without prior notice.

 

Booking Cancellation Policy

Any booking cancellations received at least 10 days prior to hire commencement date for groups A to F, and at least 20 days prior commencement date for groups H to K will be refunded in full any deposits paid on reservation. Cancellations received outside these time limits are subject to loss of deposit.

Due to COVID, we are accepting cancellations up to 24 hours from the commencement date with a full refund of any pre-booking deposit paid; we request that clients inform us immediately of their intention to cancel.
